The applicant seeks modification of the condition imposed by the order dated 20-6-2016 to the extent of depositing 50% of the amount adjudicated in the proceedings under the Minimum Wages Act, 1948. In the application, it has been stated that the proceedings under the Sick Industrial Companies Act, 1985 are going on against the applicant/Company. Reply is filed on behalf of the nonapplicant opposing the prayer as made. Perusal of the summary proceedings dated 12-5-2016 indicates that the petitioner has been restrained only from alienating or transferring immovable assets of the Company.

In view of aforesaid, I do not find any case made out to modify the aforesaid fact.

The application is dismissed. No costs.
