By this application, Central Bureau of Investigation, ACB, Nagpur seeks leave to appeal against judgment and order dated 14th January, 2015 passed by the Special Court, Chandrapur in Special (CBI) Case No.10/2006 acquitting the sole accused of the offence punishable under Sections 7, 13(1)(d) r/w 13 (2) of the Prevention of Corruption Act, 1988.
Heard Mrs. Chandurkar, learned counsel for applicant and Shri Hazare, learned counsel for respondent.
It appears from the evidence of complainant and panch witnesses that trap was successful. Pre and post trap panchanamas were drawn. From the observations of the Trial court in paragraphs 37 to 52 and evidence adduced by the department, it is apparent that applicant has an arguable case on merits. Hence, leave to appeal is granted.
Criminal Application [APPA] No.486/2016 stands allowed.
