We have noticed that the a notice u/s 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short 'Act of 2002') has been issued to the petitioner on 30.08.2021 by the Respondent No.2-Bank. Admittedly, the remedy under the Act of 2002 lies before the Debts Recovery Tribunal. Learned Advocate for the petitioner submits that at the time when the petition was filed, the post of learned Presiding Officer of the Debts Recovery Tribunal
WP.4009.21 was vacant. The DRT is now functional.

We accordingly dismiss this petition by granting liberty to the petitioner to approach the appropriate forum. All contentions raised in the petition are kept open.
