The applicant/appellant has filed the appeal to challenge the judgment passed by the learned Magistrate by which his complaint under Section 138 of the Negotiable Instruments Act, 1881 is dismissed.

Considering the facts of the case, the applicant/appellant is granted leave to file and prosecute the appeal to challenge the above referred judgment. The criminal application is allowed accordingly.
