The applicant is in jail. He has filed the present application seeking condonation of delay in filing the Appeal. On going through the Application, it is found that there is no one to look after the litigation of the applicant. Thus, the delay caused in filing the appeal is not intentional but it was due to the bona fide difficulty of the applicant.

In the interest of justice, the delay of 289 days in filing the Appeal is condoned.
