Apprehending arrest in connection with Crime No. 1278 of 2017 registered for the offence punishable under Section 376(2)(n) and 417 of the Indian Penal Code, the applicant seeks pre-arrest bail. The crime is registered on the complaint lodged by the prosecutrix, aged about 21 years, that giving assurance of marriage the applicant has sexually exploited her during the period from February, 2016 till 19th May, 2017. The complaint is lodged on 30th May, 2017. From the reply filed by the Investigating Agency before the Sessions Court (copy of which is placed on record) it cannot be said that the Investigating Agency has been able to satisfy that custody of the applicant is required for investigation.

The applicant, aged about 27 years, claims that he is serving with Central Reserve Police Force and is presently posted at Jaipur (Rajasthan). The applicant has stated that

2 aba498.17 he is permanent resident of Chinchala, Tahsil : Ramtek, District : Nagpur and that he is not involved in any other crime/ offence.

In the facts of the case, following order is passed: In the event of arrest in connection with Crime No.1278 of 2017, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Ten Thousand.

The application is allowed accordingly.
