DATE : February 22, 2017 Heard finally, in view of the fact that the parties have amicably settled the dispute.

The judgment dated 13th July 2009 in Succession Case No.29/1999 whereby the application moved by the appellant for grant of succession certificate has been rejected, is the subject matter of challenge in the present appeal.

The learned counsel for the parties jointly submit that in Writ Petition No. 4243/2015, the proceedings were placed before the Mediator and the parties have agreed to settle the dispute by sharing the amount deposited equally. A copy of order passed in Writ Petition No. 4243/2015 is taken on record and marked as "A" for identification.

In view of aforesaid settlement between the parties, judgment dated 13th July 2009 in Succession

FA945.16 2/2 Case No.29/1999 shall cease to operate.

First appeal is disposed of in the aforesaid terms. No order as to costs.
