Present application is filed under Section 439(1)(b) of the Code of Criminal Procedure for modifying or cancelling the condition imposed by the Court.

The order is passed by the Additional Sessions Judge, Nagpur by which the condition is imposed on the present applicant to deposit Rs.34,00,000/- in the Magistrate Court.

In view of Section 439(1)(b) of the Code of Criminal Procedure, the Sessions Court has power to consider this prayer.

In view of that, liberty is granted to the present applicant to approach before the Sessions Court. 6.
