After arguing for sometime, the learned Advocate for the applicants submits that the application of applicant No.2 - Mahesh Prabhudas Mesram is not pressed. The application of applicant No. 2 - Mahesh Prabhudas Mesram is dismissed as not pressed.

The applicant No.1 is arrested on 5th March, 2017 in connection with Crime No.471/2017 registered against him and his younger brother Mahesh for the offence punishable under Sections 8(c), 21 and 29 of the Narcotic Drugs and Psychotropic Substances Act. The case of the investigating agency is that 14.6 grams of brown sugar is seized from both the accused, 8.72 grams is seized from the applicant No.1 - Vikas and 5.96 grams is seized from co-accused Mahesh.

The investigation is complete and charge-sheet is filed. The applicant No.1, aged about 32 years, claims to be a labourer and has stated that he is

2 ba648.17 not involved in any other crime / offence. The non-applicant has not been able to point out that there is apprehension of repetition of crime by the applicant No.1.

Considering the above facts, following order is passed:

The applicant No.1 - Vikas Prabhudas Mesram having been arrested in Crime No.471/2017 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.50,000/- (Rs. Fifty Thousand) and furnishing two solvent sureties each for Rs.25,000/- (Rs. Twenty Five Thousand).

The application of applicant No.1 - Vikas Prabhudas Mesram is allowed in the above terms. JUDGE Tambaskar.
