Since no order prejudicial to the interests of respondent no.2 is being passed, the requirement of issuing notice to said respondent is not necessary. The limited relief claimed in the petition is for expeditious disposal of the Application filed by the petitioner against respondent no.2. As per the requirement of law, the said Application is required to be decided within a period of ninety days. Though the Application was filed way back on 2nd August, 2014, the same is not yet decided.

In that view of the matter, we dispose of

2 12.08.wp.4692.5. the instant petition with a direction to respondent no. 1 to decide the Application filed by the petitioner within a period of four weeks from today.
