The settlement terms being voluntary, genuine and legal, the Second appeal stands disposed of in terms of settlement.

The judgment and order dated 17/04/2017 passed in RCA No.97/2008 and judgment and decree dated 30/07/2008 in H.M.P. No.46/2005 are quashed and set aside.

The second appeal is allowed in terms of settlement. Decree to be drawn up accordingly. 4.

Second appeal is disposed of.
