The non-applicant, which is a coal industry, filed a regular civil suit for damages and recovery of amount Rs.10.00 lacs against the applicant.

After hearing learned counsel for the applicant and learned counsel for the non-applicant, I am of view that this is not a case wherein this Court should exercise its discretion under Section 24 of the Code of Civil Procedure. 4.

The Misc.Civil Application is rejected and disposed of accordingly.

Needless to mention that ad interim stay granted by this Court (Coram : Pushpa V.Ganediwala, J.) on 4.10.2021 stands vacated.
