Challenge in Writ Petition No.2661/2017 was to the issuance of fresh tender. This Court on 04-05-2017 while issuing notice in the matter, directed the parties to maintain status quo.

The petitioner alleges violation of that order by the Municipal Council. Learned Counsel submits that inadvertently its order constituting contempt could not be produced on record.

Said order dated 28-06-2017 produced by him during hearing is at Exhibit "X". Order shows that the petitioner has been black listed and therefore, work is cancelled. Thus, this cancellation of work and black

2 cp167.17 listing has got no bearing prima facie with subject matter of Writ Petition No.2661/2017.

Hence, the contempt petition as filed is misconceived. It is rejected. No costs.
