The applicant is seeking bail in connection with Crime 427/2020 registered with Police Station M.I.D.C., Akola, District Akola for offences punishable under Sections 302, 394, 120(B), 212 and 201 read with Section 34 of the Indian Penal Code and Sections 3/25, 5/27(1) and 7/27(3) of the Arms Act.

The prosecution case is that deceased Gopal Agrawal was proceeding on his motor-cycle from his factory premises to Akola City with a bag of cash. Witness Rajesh Bhange was accompanied the deceased. It is alleged that co-accused Vijay Rathod and Sagar Kothale followed the deceased and attempted to snatch the bag. The deceased attempted to flee from the spot. He was later on found injured, at some distance away. The case of the prosecution is that co-accused Sagar chased the deceased and shot him.

The role attributed to the applicant is that he informed the assailants that the deceased had left his factory premises with cash.

Considering that the alleged assailants are released on bail by this Court, I do not see any impediment in granting bail to the applicant who has no criminal antecedents.

The application is allowed subject to the following conditions.

[i] The applicant be released on furnishing personal bond of Rs.16,000/- (Rupees Sixteen Thousand) with solvent surety of like amount.

[ii] The applicant shall not tamper with the evidence or make any attempt to influence the witnesses, directly or indirectly.

[iii] The applicant shall not leave the country without the permission of the jurisdictional Court.
