DATE : 08/09/2022 First Appeal No.356/2018 is dismissed by conditional order dated 07/12/2018 taking effect on 07/06/2019. Since the matter was dismissed on 07/06/2019, no steps taken to restore the appeal. As such, the respondent No.1/applicant-claimant is entitled for the amount deposited by the insurance company. It is submitted that till today no amount is withdrawn by the respondent No.1.

In view of above, the application is allowed. 3.

The respondent No.1 is granted permission to withdraw the amount deposited by the appellant along with accrued interest thereon.

Registry is directed to release the amount in favour of respondent No.1 after verification of bank details and identity.

The application is disposed of.
