Heard Shri A. B. Patil, the learned Advocate for the applicant, Shri S.V. Ingole, the learned Advocate for the non-applicant no.1 and Shri Kadu, the learned AGP for the non-applicant nos. 2 and 3. Though some necessary details are lacking in the application, considering the facts specially that the non-applicants are not opposing the application inasmuch as the reply is not filed, the delay in filing the appeal is condoned.
Civil Application is allowed.
The appellant shall pay costs of Rs. 1000/- to the learned Advocate for the non-applicant no.1 and produce receipt on the record of the appeal till 20th February, 2015, failing which the appeal shall stand dismissed without reference to the Court. FA St. No.15187/2010 Taken up on board for admission by consent of learned Advocates of the respective parties.
Admit.
Shri S.V. Ingole, the learned Advocate waives notice for the non-applicant no.1 and Shri Kadu, the learned AGP waives notice for the non-applicant nos. 2 and 3.
The appellant shall file private paper book within six months, failing which the appeal shall stand dismissed without further reference to the Court.
