Drawing support from the chart drawn by the District Rehabilitation Officer, Buldhana, the contention of Mr. Karode, learned counsel appearing for the petitioners is, the husband of respondent no.6, who is Sarpanch of the Villa Panchayat, has incurred disqualification, it is claimed that the proceedings are initiated which are pending with the respondent no.1-Collector, Buldhana. 2.

The prayer in the writ petition is for expeditious disposal of the proceedings pending before the Collector.

From the record i.e. page 27, it is apparent that the husband of respondent no.6 is an encroacher. Whether such encroachment can lead to disqualification of respondent no.6 is required to be adjudicated by the respondent no.1-Collector. 4.

In this background, we dispose of the petition with a direction to the respondent no.1-Collector to decide the pending proceedings of the petitioner as expeditiously as possible and in any case within a period of three months from the production of copy of this order.
