Heard the learned Additional Public Prosecutor for the State. The learned Additional Public Prosecutor has produced case diary for perusal. I have gone through the same.

The applicants apprehend arrest in Crime No.

0388/2020, registered with MIDC Police Station for the offences punishable under Sections 498-A, 323 r/w Section 34 of the Indian Penal Code. Informant Sau Rupali Sarvesh Lohikpure, wife of the applicant No.1 has alleged in the First Information Report that her marriage with the applicant No.1 was solemnized on 15/05/2019. After the marriage, she was

15 ABA 771-2020.odt residing in the joint family of the applicants. The applicant No.1 used to come home late in the night. She was treated well for one month and thereafter she was being ill treated for petty reasons. The allegations are vague and general and appear to be normal wear and tear of marriage. 4.

The applicants were granted interim protection vide order dated 21/12/2020 and the applicants have cooperated in the investigation. The offence is registered on 30/11/2020 and the investigation is now almost complete. No custodial interrogation of the applicants is necessary, in view of the allegations made in the First Information Report. The application is therefore allowed in terms of interim order passed by this Court dated 21/12/2020.

The applicants shall attend the concerned Police Station as per the interim order till the filing of charge-sheet. 6.

The application is disposed of.
