The learned Counsel for the respondent no.1/Claimant requested for permission to withdraw the present application for filing it afresh, after removal of technical difficulties.

The learned Counsel for the appellant/Acquiring Body is not having any objection for such withdrawal. 4.

As such, the application stands disposed of as withdrawn with liberty to file any other proceedings for the same relief, as permissible in the law.

CIVIL APPLICATION NO.2129 OF 2022 5.

Heard rival submissions.

The application is for permission to withdraw the amount of compensation as awarded under the Award of the Lok Adalat dated 14.09.2019.

The learned Counsel for the appellant/Acquiring Body submits that the amount of compensation as per

2 37.fa.706.2018 the Award of aforesaid Lok Adalat, can be given to the respondent no.1/Claimant.

In view of the same, the application stands allowed and the respondent no.1/Claimant is permitted to withdraw the amount of compensation as per the Award of the Lok Adalat dated 14.09.2019.

The application is accordingly disposed of.

10.

The acquiring Body shall be at liberty to withdraw the amount of compensation, if paid in excess along with the proportionate interest accrued thereon till date.
