We are not required to go into the merits of the petition in view of the agreement between the parties that the order impugned can be set aside and the matter be remitted to the Tahsildar, Arni, District Yavatmal for fresh decision after hearing the parties in accordance with the law.

03] The matter is remitted to the Tahsildar, Arni, District Yavatmal for deciding the issue fresh uninfluenced by the earlier order. 04] Needless to say, the parties shall be heard and appropriate decision shall be taken on its own merits.
