The appeal stands dismissed against respondent nos. 1 to 4 who are the original claimants on 08.01.2013. Shri A. B. Patil learned counsel for the appellant seeks further time to take necessary steps to bring on record said claimants.
It is seen from the record that considerable time was granted to the appellant to take necessary steps. However necessary steps have not been taken. On behalf of the respondent nos. 5 and 6 it is pointed out by Smt. Deshpande, learned AGP that in identical matters arising out of same Notification this Court has confirmed amount of compensation of Rs. 1,70,000/- per hectare.
I have perused the order dated 15.09.2015 passed in First Appeal No. 750 of 2012. Same indicates that said appeal also arose from the same Notification in respect of lands situated at village Malapur.
2310fa601.13 Hence, considering aforesaid adjudication and the fact that an amount of Rs. 1,70,000/- per hectare has been found to be just and fair compensation for similarly situated lands and after considering sale instances at Ex. 28 and 29 the judgment of the Reference Court stands confirmed. Hence First Appeal No. 601 of 2013 stands dismissed with no order as to costs. JUDGE svk
