The applicant is apprehending arrest in Crime 241/2020 registered with Police Station Hiwarkhed, Tq. Khamgaon, Dist. Buldhana for offences punishable under sections 307, 504, 506 read with section 34 of the Indian Penal Code.

The submission is that concerning the same incident, cross-reports are lodged.

According to the learned counsel Mr. S.A. Mohta, the applicant is injured in the incident. The incident took place on 16.11.2020. The son of the applicant lodged report on 18.11.2020 and the delay occurred since the applicant was admitted in the hospital. On the other hand, the rival faction lodged the report on 24.11.2020.

Perusal of the material in the case diary reveals that the applicant too suffered serious injuries in the incident.

This Court directed the applicant to attend the Hiwarkhed Police Station and to co-operate with the Investigating Officer. It is not the case of the prosecution that the condition is not complied with.

Mr. V.A. Thakare points out that the applicant has criminal antecedents in as much as two offences are registered earlier. I have perused the nature of the accusations which, the applicant is facing in the previously registered offences. It does not appear that the applicant is a hardened criminal. Be that as it may, since in the present matter, custodial interrogation does not appear to be necessary the applicant deserves to be protected. 7.
The interim pre-arrest protection granted vide order dated 22.12.2020 is made absolute with the only modification that till the charge-sheet is filed, the applicant shall attend the concerned police station as and when required by the Investigating Officer.
