DATED : SEPEMBER 7, 2016 Heard learned Counsel for the applicant and the learned A.P.P. for the State. Perused the reply of the prosecution and the first information report.

Although, the suicide note puts blame clearly upon the shoulder of this applicant for commission of suicide, it appears that the deceased had engaged herself in physical relations with this applicant knowing fully well that he was a married man. It is difficult to believe that a mature woman would keep relations with a married man, who promised that he would marry her, without there being any decree of divorce and believing in such a promise, a mature woman would surrender and submit herself to such a man. Now, if the relations between such woman and the man, for some reasons, turn sour and the woman commits suicide, a question would be whether this would amount to any instigation or abetment to commit suicide and the answer, prima facie, would have to be given by taking into account the conduct of the deceased herself. I have already made some comments regarding the conduct of the deceased and I do not think it necessary to express myself more on the aspect. In the circumstances, I find that this is a fit case for grant of anticipatory bail.

The application is allowed and the interim bail granted to the applicant on 28/7/2016 by this Court is hereby confirmed on the same conditions.
