Heard the learned Counsel for the applicant and the learned A.P.P. for the State.
The learned A.P.P. has pointed out the order passed by this Court on 02/05/2016 and submits that the applicant has not approached this Court with clean hands as he has not mentioned in the application that liberty to file a fresh application could be exercised by him only in the event that the trial did not commence within six months from 02/05/2016. He is right. While the order dated 02/05/2016 is generally mentioned, nothing is mentioned about it's liberty part. The period of six months is yet to be over. The application is, therefore, rejected as not maintainable.
