The Petitioner, who is the erstwhile President of Nandura Taluka Co-operative Sale Purchase Union, has filed this Petition challenging the order dated 21 September 2020 passed by the Respondent No.5- Assistant Registrar, Cooperative Societies, Nandura, District Buldhana, appointing an Administrator on the this Co-operative Society.

The learned Counsel for the Petitioner submitted that the Administrator was appointed primarily on the ground that the elections could not be held due to COVID-19 Pandemic and that the situation has now undergone a change and there is no impediment to hold the elections.

We note that holding elections for Co-operative Societies will have to be a general decision taken by the State Government and not only specific to the Petitioner-Society, as the ground on which an Administrator was appointed is a general one. It will be appropriate that the Petitioner makes a representation to the Respondent- Authorities and the Respondent- Authorities will take a decision, considering all the facts and circumstances of the case. The learned Counsel for the Petitioner states that the representation will be made within a period of two weeks.

As regards the time-limit for disposal of the representation, considering the fact that a general decision will have to be taken by the State Government, at this stage, we do not intend to place any time-limit upon the same, except observing that the decision be taken as early as possible.
