The present petition arises out of order below Exh.104 rejecting the application preferred by the petitioner under Order 1, Rule 1(3) and 10 read with Section 151 of the Code of Civil Procedure.

Shri Gandhi, learned counsel for the respondent Nos.1 and 2 points out that, the Special Civil Suit No.18 of 2003 was dismissed vide judgment and decree dated 31.07.2019. In that view of the matter, the petition has become infructuous.
