It is submitted on behalf of respondents that in view of the substantial question of law framed by this Court, as also in view of the judgment of this Court in the case of Vijay Shrawan Shinde & Ors. vs. State of Maharashtra 2009 (5) Bom.C.R. 306, the matter may have to be remanded to the trial Court.

In view of the above, the present application is allowed and the appeal is directed to be listed for final disposal at the end of the admission board on 09.10.2019.
