Heard Shri Agrawal, the learned Advocate holding for Shri P.B. Patil, the learned Advocate for the applicant. None appears for the non-applicants.
For the reasons stated in the application and the fact that it is not opposed by the non-applicants inasmuch as the reply is not filed, the application is allowed.

Shri Agrawal, the learned Advocate submits that at the time of initiation of the acquisition proceedings, the applicant-VIDC was not in existence. It is submitted that the applicant-Corporation was not impleaded as party in the reference proceedings. The learned Advocate submits that the applicant-Corporation is directly concerned with the acquisition of the land and the amount which is to be paid as per the award has to be paid by the applicant-Corporation. In view of this fact and as the non-applicants are not opposing the application inasmuch as the reply is not filed, the application is allowed. Leave granted to file appeal. Civil Application is disposed of in the aforesaid terms. JUDGE Ambulkar
