Heard Shri Samarth, the learned Advocate for the appellant. This is an application filed by the appellant praying that the respondent be directed to deposit an amount of Rs. 11,49,305/-. Considering the fact that the appellant had not been diligent in prosecuting the application and it is pending since 2010, I do not see any reason to consider the application at this stage. The civil application is rejected.

It is clarified that the issue raised by the appellant in the civil application is kept open to be considered at the time of final hearing of the appeal.
