The applicant / appellant has filed appeal to challenge the judgment passed by the Sessions Court by which the appeal filed by the non-applicant / respondent is allowed and the judgment passed by the learned Magistrate convicting the non-applicant / respondent for offence punishable under Section 138 of the Negotiable Instruments Act, 1881 is set aside. After hearing the learned Advocates for the respective parties, I find that the applicant has made out a case for grant of leave to file appeal. The applicant is accordingly granted leave to file and prosecute the appeal to challenge the above referred judgment.
