By way of the present petition, the petitioners challenge the order dated 11.02.2016 passed below Exhibit - 5 in Regular Civil Suit No. 277 of 2015 by the learned 2nd Joint Civil Judge, Junior Division, Akola, under Order 39 Rule 1 of the Code of Civil Procedure, whereby the application filed by the applicants came to be rejected. Against that order, the petitioners filed Misc. Civil Appeal No.36 of 2016 before the learned Ad-hoc District Judge-1, Akola. The said appeal also came to be dismissed by the Appellate Court.

In view of the fact that since 2017, there is no any protection was granted in favour of the petitioners and only on this ground alone, I am not inclined to entertain the present petition. Hence, I proceed to pass the following order :

i) Writ Petition No.5534 of 2017 is dismissed. No order as to costs.
