Apprehending arrest in connection with Crime No.170/2017 registered by the non-applicant for the offence punishable under Section 420 of the Indian Penal Code, the applicant has sought pre-arrest bail. The accusations against the applicant are that in July, 2007 he had agreed to sell a flat to the complainant for Rs.7,50,000/-, accepted amount of Rs.4,00,000/-, however, he has not executed the sale-deed. According to the complainant, the applicant is demanding more amount to execute the sale deed. Prima facie the nature of accusations show that it is a civil dispute.

The application is opposed on the ground that crimes for similar offences are registered against the

The learned Advocate for the applicant has submitted that as far as the crimes registered in 2012 are concerned, charge-sheet is not filed and as far as crimes registered in 2015 and 2016 are concerned, the applicant is released on bail after considering the facts of those cases. One of the grievance of the investigating agency is that the applicant is not co-operating with it. In the facts of the case, following order is passed:

In the event of arrest in connection with Crime No.170/2017 registered by the non-applicant, the applicant be released on bail on furnishing cash security of Rs.1,00,000/- (Rs. One Lakh) and furnishing one solvent surety in the like amount.

Till the charge-sheet is fled, the applicant shall attend the police station, Imamwada, Nagpur on every Saturday between 11 a.m. to 1 p.m.
