We have heard respective learned counsel for the parties for some time.

Prima facie, we find that petition has been filed only to kill time and to defeat the process of law. It is nothing but abuse of process of law. However, we are not concluding this aspect finally, as learned counsel Shri Masood Shareef for the petitioners states that he would file appropriate proceedings in accordance with law. He seeks leave to withdraw the petition with liberty to file such proceedings.

Subject to petitioners' depositing amount, as claimed, with the Assistant Director of Town Planning, Yavatmal, and additional amount of Rs.20,000/- only to show bona fide with that authority, within a period of four .....2/-

wp5249.15 weeks from today, we grant liberty as prayed for. If amount is so deposited, the petitioners are free to file appropriate proceeding as per law. With the said liberty, we dispose of the present petition as withdrawn.
