Shri Patil, the learned Assistant Government Pleader appearing on behalf of the respondent nos.1 to 4, states that the petitioner has been appointed on a Class-III post at Akola during the pendency of the writ petition and, hence, the petitioner would not be desirous of seeking appointment on a Class-IV post, with which we are concerned in this petition.

Shri Kulkarni, the learned counsel for the petitioner, fairly states that the petitioner would not like to seek the relief as sought in this petition as he has been appointed on a higher post.
