Heard.
The applicant is apprehending arrest in Crime 126 of 2018 registered at Ambazari Police Station for offence punishable under section 376(1)(2)(n) of the Indian Penal Code.
The offence is registered on the basis of the accusation that although the applicant and the prosecutrix were in a relationship and marriage was promised, the applicant did not fulfill the promise on the pretext that the prosecutrix is not having good family background. The material on record would suggest a very strong possibility that the accusation is the fall out of a relationship having gone sour. The learned counsel for the applicant states that although he has attended the Police Station, the mobile set was not asked for by the Investigating Officer. The applicant is ready to hand over the mobile to the Investigating Officer immediately. The interim order dated 6.7.2018 is confirmed
aba484of18.odt 2 with modification that the applicant shall attend the Police Station Ambazari on 24.7.2018 and hand over the mobile to the Investigating Officer and shall thereafter attend the Police Station as and when required by the Investigating Officer.
