Pophaly, learned counsel for appellant. The learned counsel for respondent no.3 submits that application for respondent no.3 is not pressed at this stage.

Perused judgment and award dated 4.9.2013 passed by the Motor Accident Claims Tribunal, Yavatmal.

Respondent no.1/widow of deceased is permitted to withdraw an amount of Rs.1,95,000/- granted to her share by the tribunal on furnishing usual undertaking within two weeks stating therein that in case appellant succeeds she would repay the entire amount with interest thereon.

Civil Application stands disposed of.
