In view of the decision of the Calcutta High Court in case of Uniworth Textiles Ltd., Vs. Joint Development Commissioner, SEEPZ, 2002 (144) E.L.T 515 (Cal.), the learned counsel for the appellant seeks to withdraw this appeal with a liberty to file the same in the High Court at Calcutta.

The learned counsel for the respondents objects to this submission that this Court has jurisdiction and according to him Calcutta High Court has no jurisdiction.
