Heard Shri S.K. Tambde, Advocate for the petitioner and Shri A.D. Sonak, A.G.P. for the respondent No.1.

The petitioner has challenged the order passed by the Election Officer rejecting the application of the petitioner objecting to the voters' list. It is the submission on behalf of the petitioner that the category of individual member is not separately shown because of which the interests of factory members will not be taken care of for want of their representative in the Board.

The bye-laws of the Society are amended in 2013. It is not disputed by the petitioner that the voters' list is prepared in consonance with the bye-laws. The petitioner has

2 wp4319.16 not been able to show why the petitioner has not challenged the bye-laws since last three years.

In the above facts, I am not inclined to entertain the grievance of the petitioner. The petition is dismissed. In the circumstances, the parties to bear their own costs. C.A.W. NO.1649/2016.

In view of disposal of main petition, this application does not survive and is disposed accordingly. JUDGE Tambaskar.
