Vide impugned order, the petitioner, nonapplicant to the D.V. proceedings has moved an application under Section 340 of the Criminal Procedure Code against the original applicant, which is ordered to be deferred. 3.

The order impugned was passed on 27.11.2019 i.e. almost 5 years back.

Apart from above, it is not that the application of the petitioner is rejected.

We are sensitive to the position of law that the application preferred under Section 340 of the Criminal Procedure Code is to be decided expeditiously. 6.

That being so, with the assistance of the learned A.P.P. having gone through the record, the petition can be disposed of with observations that in case, if the application preferred by the petitioner under Section 340 of the Criminal Procedure Code is pending as on date, it shall be decided expeditiously.

With these observations, the Criminal Writ Petition stands disposed of.
