Heard Ms. Peeti Rane, learned counsel for the petitioner, Shri R.E. Moharir, learned counsel for respondent Nos. 1 & 2 and Shri A.A. Madiwale, learned AGP for respondent No. 3.

Admittedly, the caste claim of the petitioner is still not decided.

The learned AGP, upon instructions, seeks time of one year to complete verification as the vigilance report is still to be received.

Shri Moharir, learned counsel submits that the petitioner has been appointed on temporary basis and cannot be confirmed until and unless validity is received. 5.

In this situation, we grant respondent No. 3 time of one year from today to adjudicate the caste claim of the petitioner. Interim orders granted on 04.08.2016 to

1906wp4442.16 continue till then and shall be subject to final adjudication by Respondent No. 3.

Writ Petition is accordingly partly allowed and disposed of. However, there shall be no order as to costs. JUDGE JUDGE *GS.
