By this application, it is prayed that the delay in filing the second appeal be condoned.

The reasons for the cause of delay are mentioned in paragraphs 2 to 5 of the application. The application is opposed by the non-applicants by filing reply. It is submitted that the reasons mentioned in the application are not sufficient to condone the delay.

Heard learned counsel for the parties and perused the application as well as the reply. The proceedings arise from a suit for partition and separate possession. Considering the reasons mentioned, I do not find that the delay has been deliberately caused. Hence, accepting the reasons mentioned, the delay stands condoned.
