Though all the respondents are served, the contentions raised in the petition are not controverted by the respondents, particularly the respondent No.2.

The bank account of the petitioner being Account No.0813002100318441 operated with respondent No.4-Punjab National Bank, Lakadganj, Nagpur is informed to have been seized. The balance amount in the said account is Rs.7.95 lakhs which was expected of the respondent No.2 to bring to the notice of the Court as to the cause for which the account is directed to be seized and the amount involved in the offence which has come from the said account. 3.

The respondent Nos.2 and 3 has failed to demonstrate the flow of amount involved in the offence to the account of the petitioner. Rather a communication issued which led to freezing of account is too vague to deal with the issue sought to be canvassed.

That being so, we direct the respondents to defreeze the account of the petitioner being Account No.0813002100318441 with respondent No.4-Punjab National Bank, Lakadganj, Nagpur on the condition of petitioner giving an undertaking to this Court that in case in future if any amount is noticed to have been received in the said account in connection with the alleged offence, the petitioner shall deposit such amount in this Court over which the respondents will be required to establish their claim and such deposit by the petitioner shall be without prejudice to her right and contention. 5.
