The application is for condonation of delay.

Learned Counsel for the applicant submitted that the applicant was under the impression that the limitation period is of 90 days and therefore, the delay of 12 days is caused. Though, non-applicant is served with the notice, he fails to appear. In view of the reasons mentioned in the application which appears to be just and reasonable, the delay of 12 days is condoned. 3.

The application is disposed of.
