By the impugned order the learned District Judge has permitted the respondent (appellant before District Court) to amend the memo of appeal to incorporate three additional grounds. The additional grounds which are raised by the respondent (appellant before the District Court) are on legal submissions. The learned District Judge has rightly permitted the respondent (appellant before District Court) to incorporate the additional grounds. It cannot be said that the learned District Judge has committed any illegality or error of jurisdiction which necessitates interference by this Court in the extraordinary jurisdiction. Prima-facie it appears that the petition is frivolous and is filed with intention to delay the hearing of the appeal before the District Judge. The writ petition is dismissed. No costs.
As the appeal is of 2014,the learned District Judge is directed to decide the appeal till 30th September 2019. JUDGE RRaut..
