2) We find that the petitioner has not as yet availed of the alternate remedies, which are available to him and which, in our opinion, are equally efficacious as, for example, making a representation to the superior-most Authority in the administrative hierarchy for seeing that the respondent no.2 complies with the directions issued by the superior Officer, i.e. respondent no.1 and he is not continued to be an erring Officer.

2010wp6625.22 2/2 3) Shri Sambary, learned Counsel for the petitioner, agrees and seeks leave of the Court to withdraw the petition with liberty to approach the higher Authority for redressal of the grievance of the petitioner.

4) Leave with liberty as prayed for is granted, keeping all questions open. The petition is disposed of as withdrawn.
