Apprehending arrest in Crime No.343/2017 registered for the offence punishable under Section 65(e) of the Maharashtra Prohibition Act, the applicants seek pre-arrest bail.

According to the investigating agency, though sale of liquor in Chandrapur district is prohibited, the stock of liquor worth Rs.35,700/- is seized from the room occupied by the applicants as lessee.

By order passed on 17th July, 2017 this Court has granted interim protection to the applicants. It is not the complaint of the investigating agency that the applicants have misused the interim protection granted by this Court or have not co-operated with it. The non-applicant has not been able to point out that custody of the applicants is required for further investigation.

2 aba505.17 The applicants, aged about 23 years, claim to be students and have stated that they are not involved in any other crime / offence.

Considering the facts of the case, order passed by this Court on 17th July, 2017 granting protection to the applicants is confirmed. The application is allowed accordingly.
