According to the petitioner, he has challenged his rustication by preferring an appeal and finally on 09.05.2025 (at Page 37), his appeal was rejected by the Assistant Commissioner of Social Welfare, Nagpur. Being aggrieved, the petitioner thereafter preferred appropriate proceedings before the respondent no.2-Regional Deputy Commissioner of Social Justice and Special Assistance Department, Nagpur. These proceedings are pending before the respondent no.2.

Considering the contention that the proceedings are pending, we are not inclined to interfere in writ jurisdiction.

We direct the respondent No.2 to decide the proceedings if pending before it within a period of two weeks from the date of appearance of the petitioner. The petitioner shall appear before the respondent No.2 on 29.09.2025 at 1:00 p.m.

It is clarified that if on the date of appearance petitioner fails to appear, the respondent No.2 is at liberty to proceed with the matter.

With the aforesaid directions, the writ petition stands disposed of accordingly.
