The learned counsel for the applicant states that in view of the existence of an alternate remedy under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, the writ petition is liable to be disposed of and the petitioner should be permitted to avail the said remedy.

Since the writ petition is admitted after hearing the learned counsel for the applicant and the stay is granted, the relief as prayed in this civil application cannot be granted. However, the writ petition may be listed for final hearing on 22.08.2016. The civil application stands disposed of accordingly. JUDGE JUDGE APTE
