By this petition, the petitioner impugns the order of the Additional Commissioner, Amravati granting ad-interim relief in favour of the respondent no.5, without hearing the petitioner though a caveat was filed in the matter.

Shri Muley, the learned counsel for the petitioner, states that after the impugned order dated 16.07.2015 was passed, this Court had permitted the Additional Commissioner to pass appropriate orders on the stay application as also on the appeal filed by the respondent no.5. It is stated that during the pendency of the writ petition, the Additional Commissioner, Amravati has heard the appeal and the appeal is closed for orders. In view of the aforesaid statement, since no interim relief is operating in favour of the petitioner since the filing of the petition on 12.08.2015, this writ petition is disposed of with a direction to the Additional Commissioner, Amravati Division, Amravati to decide the appeal filed by the respondent no.5 as early as possible and positively within a period of one month. Order accordingly, no costs.
