However, there is an objection taken by the Registry that the revision may not be maintainable. 4.

Mr. S. D. Patil, who is holding for Mr. S. P. Kshirsagar, is seeking time on the ground that the issue shall be argued by his senior.

However, I do not consider it necessary to adjourn the hearing. The order impugned is passed by the learned Magistrate in proceeding under 138 of the

2 revn 3.2021 Negotiable Instruments Act whereby the application preferred by the applicant-accused seeking direction to the Manager of Bank of India, Pusad Branch to produce on record certain documents is rejected.

Even if it is assumed, as is argued that a revision lies, it would have been more appropriate to approach the Sessions Judge in revision.

I do not consider it appropriate to directly entertain the revision.

Whether the order impugned is revisable, is left to the revisional court to decide on merits.

This application is disposed of with liberty to the applicant to approach the Sessions Judge, if according to the applicant, the order impugned is revisable. JUDGE wasnik
